Ma\u0142opanewska 18\/2, 54-212 Wroc\u0142aw, Poland.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms and Conditions are addressed both to Consumers and to Businesses using the Shop, and set out the rules for using the online Shop and the rules and procedure for concluding distance Sales Agreements with the Customer through the Shop.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 2 Definitions<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Business Days<\/strong>&nbsp;means Monday to Friday, excluding public holidays.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Consumer<\/strong>&nbsp;means a consumer within the meaning of the Consumer Rights Directive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Customer<\/strong>&nbsp;means any entity making a purchase in the Shop.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Terms and Conditions<\/strong>&nbsp;means these Terms and Conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Seller<\/strong>&nbsp;means Like24 sp. c. Krzysztof Dyrda Jakub Ko\u0142odziej Aleksandra Kras, NIP (tax ID) 8943141824, REGON 383272902, at ul. Ma\u0142opanewska 18\/2, 54-212 Wroc\u0142aw, Poland.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Shop<\/strong>&nbsp;means the Like24 online shop run by the Seller at https:\/\/www.like24.pl.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Likes&nbsp;<\/strong>means the Instagram, Facebook and TikTok services (likes, followers, views, comments and others) offered in the Shop.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Order<\/strong>&nbsp;means the Customer's offer, submitted through the Order Form, to conclude a Sales Agreement with the Seller for a Product or Products.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 3 Contacting the Seller<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer can contact the Seller by email at:&nbsp;kontakt@like24.pl<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 4 Refunds and complaints<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A refund is not possible once the service has been performed correctly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A complaint about purchased Likes will be considered within 14 days of receiving an email at:&nbsp;kontakt@like24.pl&nbsp;describing the problem the complaint relates to.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the complaint is found to be justified, the Seller may, taking the Customer's comments into account, make corrections that result in the service being performed correctly, or may refund all or part of the amount paid, depending on the type of problem and the Customer's requests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Refunds are made using the fast payment systems listed in \u00a7 7 of the Terms and Conditions. If a refund is needed for a transaction the Customer paid by card, the Seller makes the refund to the bank account linked to the Customer's payment card.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 5 Technical requirements<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To use the Shop properly, you need:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1. a device with internet access;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2. a web browser that supports JavaScript and cookies;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3. an active email account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 6 General information<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To the fullest extent permitted by law, the Seller is not liable for disruptions, including interruptions in the operation of the Shop, caused by force majeure, unlawful actions of third parties or incompatibility of the online Shop with the Customer's technical infrastructure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Browsing the Shop's range does not require creating an Account. The Customer can place orders for Products in the Shop's range by providing the personal data and email address needed to fulfil the Order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prices in the Shop are given in Polish z\u0142oty (PLN) and include VAT.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The total payable by the Customer is the price of the Product shown on the Shop's pages when the Order is placed (including at the moment the Customer agrees to be bound by the Sales Agreement), plus any payment processing fees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Sales Agreement becomes binding on both parties when the Customer makes the payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 7 Payments<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Orders can be paid for through:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>the CashBill payment platform; online payments are processed by CashBill S.A.<\/li><li>the Blue Media payment platform; online payments are processed by Blue Media S.A.<\/li><li>the Cardinity card payment operator; card payments are processed by Cardinity UAB.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The payment platforms support the following payment channels:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>fast payments,<\/li><li>Pay by link,<\/li><li>BLIK.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Orders must be paid for within 2 Business Days of being placed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Please note that, by their nature, some payment methods can only be used to pay for an order immediately after it is placed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 8 Placing and fulfilling an Order<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller is obliged to perform the services free of defects.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Order is fulfilled automatically once the Seller receives the payment (for card payments, automatically once the payment is successfully authorised).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller fulfils the Order within 12 hours of receiving the payment or successful payment authorisation. However, delays in fulfilling the Order may occur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Likes purchased in the Shop are delivered to the account and photo links given by the Customer when placing the Order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 9 Limitation of liability<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The subject matter of agreements concluded under these Terms and Conditions is the paid delivery of Likes to the account and photo links given by the Customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 10 Right of withdrawal&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The service is performed once the Order is paid for, at which point the system automatically submits the order to add Likes to the link provided by the Customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Art. 38(1) of the Polish Consumer Rights Act of 30 May 2014, the Customer has no right to withdraw from the agreement once the Order has been paid for. Any requests concerning possible withdrawal from the agreement are considered individually. The decision to grant withdrawal is made after analysing the costs the Seller has incurred up to the time of the request and the costs the Seller cannot avoid afterwards in connection with the Order the request relates to.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 11 Complaints<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the service is defective, the Customer can file a complaint about it under the statutory warranty provided for in the Polish Civil Code.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the statutory warranty, the Customer may, on the terms and within the time limits set out in the Civil Code:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>request a price reduction,<\/li><li>in the case of a material defect, withdraw from the agreement,<\/li><li>request that the service be performed again free of defects,<\/li><li>request removal of the defect.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller asks that warranty complaints be sent to the postal or email address given in \u00a7 3 of the Terms and Conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Complaints about the operation of the Shop should be sent to the email address given in \u00a7 3 of the Terms and Conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller will consider the complaint within 14 days of receiving it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 12 Out-of-court complaint and redress procedures<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Detailed information on the Consumer's options for using out-of-court complaint and redress procedures, and the rules for accessing them, is available at the offices and on the websites of district or municipal consumer advocates, social organisations whose statutory tasks include consumer protection, the Provincial Trade Inspectorates, and at the following websites of the Polish Office of Competition and Consumer Protection (UOKiK):<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"http:\/\/www.uokik.gov.pl\/spory_konsumenckie.php;\" rel=\"nofollow\">http:\/\/www.uokik.gov.pl\/spory_konsumenckie.php;<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"http:\/\/www.uokik.gov.pl\/sprawy_indywidualne.php\" rel=\"nofollow\">http:\/\/www.uokik.gov.pl\/sprawy_indywidualne.php;<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"http:\/\/www.uokik.gov.pl\/wazne_adresy.php.\" rel=\"nofollow\">http:\/\/www.uokik.gov.pl\/wazne_adresy.php.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 13 Personal data<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The controller of the personal data provided by the Customer while using the Shop is the Seller.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer's personal data is processed mainly on the basis of the agreement and in order to perform it, in line with Regulation (EU) 2016\/679 of the European Parliament and of the Council (General Data Protection Regulation, GDPR).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Detailed information on how the Seller processes data is given in the Privacy Policy published in the Shop.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 14 Final provisions<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer is prohibited from providing unlawful content.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each order placed in the Shop is a separate agreement and requires separate acceptance of the Terms and Conditions. The agreement is concluded for the duration and purpose of fulfilling the order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller communicates with Customers in Polish or English, as the Customer chooses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of a dispute with a Customer who is not a Consumer, the competent court is the court with jurisdiction over the Seller's registered office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For Customers who are not Consumers, Polish law governs matters relating to these Terms and Conditions (including the services provided). For Consumers, Polish law applies, but the choice of Polish law is without prejudice to the protection given to consumers by the mandatory provisions of the law of the country of their habitual residence, and by European law or other law applicable to the Consumer, in line with Regulation (EC) No 593\/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations. In particular, this means that if the national law applicable to a given Consumer provides broader protection than these Terms and Conditions or Polish law, that broader protection applies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If any provision of these Terms and Conditions would limit the Consumer's rights under mandatory provisions of law that cannot be limited or excluded in relations with a Consumer, those provisions of the Terms and Conditions do not apply to a Customer who is a Consumer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We care about your privacy and want you to feel comfortable while using our services. That is why below we present the most important information about how we process your personal data and about the cookies used by our Shop. Ma\u0142opanewska 18\/2, 54-212 Wroc\u0142aw, Poland.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What personal data we collect and why we collect it<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Comments<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When visitors leave comments on the site, we collect the data shown in the comments form, and also the visitor's IP address and browser user agent string to help spam detection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An anonymised string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service Privacy Policy is available here: https:\/\/automattic.com\/privacy\/. After approval of your comment, your profile picture is visible to the public in the context of your comment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Media<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you are a registered user and upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Cookies<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you leave a comment on our site, you may opt in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment.
